Acting Chairman of the ruling All Progressives Congress, APC, Kaduna State, S I Danladi Wada has dragged Governor of Kaduna state, Nasir el-Rufai for alleged violation of his fundamental human rights.
Also joined in the suit filed before the High Court of justice kaduna state, is one Shuaibu Idris Lauje of No. 4, Ali Akilu Road Kaduna, Commissioner of Police kaduna State command and Director of SSS, kaduna state, respectively.
In the application for the enforcement of his fundamental human rights filed against the four respondents and made available to Journalists in kaduna, Wednesday, Wada is praying the court for the reliefs on the above motion papers, and the matter has been adjourned to the 21st March 2018 for mentioning.
“A declaration that steps being taken by the Respondents to effect the arrest of the Applicant wrongfully is an infringement on the right to liberty of the Applicant and amounts to a gross violation of his Fundamental Human Rights guaranteed under sections 35 (1) of the Constitution of the Federal Republic of Nigeria, 1999 (as amended) and is therefore illegal, unconstitutional, null and void.
“A Declaration that the threats of arrest of the Applicant by the
Respondents is part of a coordinated attempt/strategy at curtailing the freedom of the Applicant in breach of constitutional provisions
particularly section 35 (1) of the Constitution of the Federal Republic of Nigeria, 1999 (as amended) and it goes to naught as same is invalid, null and void”, it added.
The letter continued that “an Order of Perpetual Injunctions restraining the Respondents, themselves, their privies, servants, agents, officers or otherwise howsoever or whomsoever from carry out any acts or omission which is likely to violate the Applicant’s liberty and freedom as this would amount to a denial of his fundamental right guaranteed under the Constitution of the Federal Republic of Nigeria, 1999 (as amended) N100, 000, 000 (one Hundreds million naira ) being aggravated, punitive and general damages against the Respondent jointly and severally for the attempt at violating the Applicant’s fundamental rights, which is a threat under the law and therefore compensatory and for Such Further Order Or Orders as this Honourable Court may deem fit to make in the circumstances of this suit.
The suit was filed by Barr. Yusuf Dankofa, Ph.D, Professor of Law, of Yusuf Dankofa & Co. of Suite 003, Choice Plaza, No. 23/24, Alkali Road, Kaduna on behalf of the applicant.
