The Kaduna State governorship election petition tribunal has dismissed an application filed by governorship candidate of the Peoples Democratic Party (PDP), Alhaji Isa Muhammad Ashiru seeking to recount ballot papers used in March 9 elections.
The Chairman of the tribunal, Justice Ibrahim M. Bako gave the ruling citing “abuse of court process” by the applicants.
He said, “There is no provision of the law or the electoral Act that empowers the tribunal to embark on judicial recount of votes other than INEC itself”.
The PDP governorship candidate had at the resume hearing last Saturday applied for the recount of ballot in some polling units and wards of Kaduna North, Kaduna South, Igabi, Birnin Gwari, Giwa, Zaria, Sabon Gari, Makarfi, Kudan, Kubau, Soba and Ikara local government areas, mostly won by the APC.
Ruling on the mateer, the Tribunal Chairman said Petitioner’s withdrawal of it earlier petition demanding for recount of ballot in all the 23 local government areas without the leave of the tribunal amounted to amendment of their petition which was quiet erroneous and abuse of court process.
Speaking to Newsmen after the ruling, Mr. Abdulhakeem Mustapha (SAN), Counsel to El-Rufai also told newsmen that the “the application filed by the petitioners for recount in certain polling units was taken today (Tuesday) and the court found no merit in application and dismissed it. We are very pleased with it, is the reflection of the position law and we are gratify.”
He said: “For us as counsel to Mallam Nasir El-Rufai, we are ready to defend the mandate and prove that the last election that returned El-Rufai as the winner and governor of Kaduna State is the correct one and we will persuade the court in that direction with all available documents to show that the mandate emanated from the good people of Kaduna State.”
